One Team Report's website located at https://oneteam.report/ (the “Site”). Please read these Terms of Service (the “Terms”) and our Privacy Policy (“Privacy Policy”) carefully because they govern your use of our Site and our design application collaboration and development platform and related tools and services accessible via our Site and other Windows and macOS-based applications. To make these Terms easier to read, the Site and our services are collectively called the “Services”, and the terms “One Team Report” “we,” and “us” refer to One Team Report and our affiliates and subsidiaries.

1. Agreement to Terms

By using our Services, you agree to be bound by these Terms. If you don’t agree to be bound by these Terms, do not use the Services. If you are accessing and using the Services on behalf of a company (such as your employer) or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms. In that case, “you” and “your” will refer to that company or other legal entity.

2. Privacy Policy

Please refer to our Privacy Policy for information on how we collect, use and disclose information from our users. You acknowledge and agree that your use of the Services is subject to our Privacy Policy.

3. Changes to Terms or Services

We may update the Terms at any time, in our sole discretion. If you do not agree to the changes made to the Terms of Service, you may terminate your subscription prior to the Effective Date. After the Effective Date, you agree to the updated Terms of Service by continuing to use our services.

4. Services & Types of Accounts

4.1 Free Trial

The free trial period shall last for a period 30 days. Customers wishing to continue the subscription once the free trial ends, must submit payment details.

4.2 Paid Accounts

One Team Report offers a variety of user accounts. You can find information about the current available types of accounts offered by us, including their features and pricing here.

5. Subscriptions, payment obligations and definitions

A team subscription allows one or more Authorized Users to access the Services. Customer Manager may add and remove individuals from the team subscription.

“Customer Manager” is the organization that you represent in agreeing to the agreement. If you signed up for a team subscription using your corporate email domain, your organization is a Customer Manager.

Subscriptions commence when we make them available to Customer and continue for a 30-day period or the term specified in the Order Form, as applicable. Each subscription is for a specified term.

GDPR: (General Data Protection Regulation) is (EU) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

"Licensee" defines a corporation which has subscribed to One Team Report services.

"Operator" provider of access to the Internet.

"Personal data" or "PD": within the meaning of article 4 (1) of the GDPR: “any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.”

"Processing": Within the meaning of article 4.2 of the GDPR: “any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.”

"SaaS (software as a service)" is software application remotely accessed through the web, like a service.

Server(s): material- or software-type device enabling access to certain services, whether they are accessible or not through the web.

"Software": all programs, processes, rules, and documentation pertaining to the operation of a data processing set (Decree of 12.22.1981 regarding the enhancement of computer vocabulary – JO of 01.17.1982). Under these general terms and conditions, the SOLUTION corresponds to the SOFTWARE involved in the contract.

"The solution" is the One Team Report software accessible in SaaS mode.

"User(s)" is any person using the "the solution".

6. Modifications to the Service and Fees

One Team Report reserves the right to modify, suspend, or discontinue the Service at any time for any reason with or without notice.

One Team Report reserves the right to change our monthly/annually fees upon 30 days notice from us. Fee change will be notified per email to all our subscribers and will be reflected on the Pricing page.

One Team Report reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service.

7. Network and access to the Solution

A connection to the Internet is required for access to the SOLUTION. One Team Reportis not responsible for the proper operation of that network. Subject to the provisions of these terms and conditions, access to the SOLUTION is available 24 hours a day, 7 days a week, including Sundays and holidays.

8. Security access to the solution and equipment protection

The registration process is subject to prior acceptance of these general terms and conditions. Access to the SOLUTION is secured by a password assigned to the USER, who agrees to keep it confidential. The USER is entirely responsible for the security information transmitted to him (her) and is responsible for its confidentiality. Such information may only be modified at his (her) request. A USER who loses his (her) identifiers or who notices the illegal use of such identifiers shall immediately notify One Team Report thereof.

The USER shall be liable for the protection of the equipment enabling his (her) access to the SOFTWARE and ensuring the preservation of his (her) data against any malicious attack. One Team Report shall not be liable for damages to the USER’s equipment and/or data through the Internet network or otherwise.

9. Cancellation, Termination and Suspension of Services

You alone are responsible for properly cancelling your Account. An email or phone request to cancel your Account shall result in cancellation. Any cancellation of your Account will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all Content in your Account. This information cannot be recovered from One Team Report once your account is cancelled. Please be aware that you can cancel at any time, but you will remain liable for all charges accrued up to that time, including full monthly charges for the month which you discontinued service. You will not be charged again.

One Team Report reserves the right to (i) modify or discontinue, temporarily or permanently, the Service (or any part thereof) and (ii) refuse any and all current and future use of the Service, suspend or terminate your account (any part thereof) or use of the Service and remove and discard any of Your Content in the Service, for any reason, including if One Team Report believes that You have violated these Terms of Use.

One Team Report will use all reasonable efforts to contact You directly to warn You prior to suspension or termination of Your account. Any suspected fraudulent, abusive, or illegal activity that may be grounds for termination of Your use of Service, may be referred to appropriate law enforcement authorities. One Team Report shall not be liable to You or any third party for any modification, suspension or discontinuation of the Service.

Access to the SOLUTION or any of its functionalities may occasionally be suspended to allow interventions and maintenance required to ensure the proper operation of the software. One Team Report shall not be liable for any consequences related to the unavailability of the service as a result of a maintenance operation or an update of the services.

10. Marketing Communication

By agreeing to these general terms and conditions, the CLIENT authorizes One Team Report to disclose their collaboration and to share the CLIENT’s trade name and represent its logo in its communication materials.
